We value your privacy. This Privacy Policy describes what information we gather from you (a “User”), how we use that information and in some instances how we share that information.  By using our Site, you expressly consent to the information handling practices described in this Privacy Policy.

What we collect (Partners or Members) 
We may collect the following information from you when you order or register on our Site or fill out a form. You may be asked to enter your:

  • Name, job title, and place of employment
  • Contact information including email address, physical address, phone number(s)
  • Demographic information such as preferences, interests, experience, background or skills
  • Other information relevant to customer surveys, offers, purchases, etc.

Copyrights, trademarks and other intellectual property matters
The Site contains copyrighted material, trademarks and other proprietary information, and the Site itself is copyrighted. This Site is owned and operated by Disaster Resource Alliance (DRA), a fiscally sponsored project of OneOC. All graphics, logos, headers, button icons, scripts, and service names are either trademarks of DRA, and/or its owners/shareholders or licensed to DRA for use. All other trademarks not owned by us that appear on our Site are property of their respective owners. You may not copy, distribute, transmit, publish or otherwise use any of the copyrighted material or trademarks in violation of applicable law without the express prior written consent of DRA. Unless you have the full legal right to do so, you also may not post or otherwise make available on the Site any material without the consent of any copyright, trademark or other proprietary rights of owner.

Restrictions on conduct
We reserve the right to prohibit conduct, communication, or content that we deem in our sole discretion to be unlawful or harmful to us, any User, or any third party. Notwithstanding the foregoing, we cannot ensure prompt removal of questionable content after online posting. Accordingly, neither DRA, nor any of its officers, directors, employees, or agents assumes any liability for any action or inaction with respect to conduct, communication, or content on the Site.

Disclaimers and limitations of liability
The Site is provided on an "AS IS," "as available" basis. Neither DRA nor its officers, directors, employees, agents, make any representation that content provided on the Site is applicable or appropriate for your use whether in locations inside or outside of the United States. DRA specifically disclaims warranties of any kind, either express or implied, including but not limited to warranties of title, implied warranties of merchantability or fitness for a particular purpose, non-infringement, or any warranty arising from course of dealing or usage of trade. No oral advice or written information given by DRA, or any of its officers, directors, employees, agents or others shall create a warranty. You expressly agree that the use of the Site is at your sole risk. DRA is not a legal or medical organization and no information on this Site should be treated as legal or medical advice. Consult your attorney or doctor as appropriate before acting on information from this Site.

Under no circumstances shall DRA, or any of its officers, directors, employees, agents or others be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use the Site, including but not limited to reliance by a User on any information obtained at the Site, or that result from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to DRA, any records, programs or services.

We may suspend or terminate your use of the Site if you violate any of these Terms of Use. We also may suspend or terminate your use of the Site if we are unable to verify information you provide to us or if we suspect that your actions may harm us or the Site or another User or potentially cause legal liability to us, you, or any third party. We reserve the right to modify or terminate the Site or your access to the Site for any reason, without notice, at any time, and without liability to you.

You agree to indemnify and hold harmless DRA and each of its officers, directors, employees, consultants, agents, subsidiaries and affiliates from any and all claims, demands, losses, liabilities, damages and expenses (including costs of investigation and defense, including attorneys' fees) of any kind and nature whatsoever arising out of or in any way connected with your violation of these Terms of Use, or your violation of any applicable law, rule or regulation, or your violation of any other person's rights, including without limitation any violation or infringement of any person's copyright or other intellectual property right or privacy rights. Your indemnification obligation will survive and continue in effect after any termination of this agreement or of your use of the Site.

Arbitration; Location
If a dispute arises related to use of the Site, this Privacy Policy and Terms of Use, or the breach thereof, and if said dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation under the Commercial Mediation Rules of the American Arbitration Association, before resorting to arbitration. Any such dispute that cannot be resolved by mediation within 30 days shall be finally resolved by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction. The arbitration will be conducted In the English language In Orange County, California, in accordance with the United States Arbitration Act. There shall be three arbitrators, named in accordance with such rules.
